Hukumu Mbeya Imetuachaje Katika Harakati Ya Kulinda Bandari Zetu?

Katika kutetea rasilimali ya nchi isingie kwenye umiliki wa wageni, Wakili Boniface Mwabukusi pamoja na mawakili wengine wamewawakilisha watanzania kwenye kesi waliyoifungua Mahakama Kuu Kanda ya Mbeya nchini Tanzania ikipinga mkataba wa makubaliano ya uwekezaji wa bandari baina ya serikali ya nchi hiyo na kampuni DP World ya Dubai.  Washtakiwa kwenye kesi hiyo ni Mwanasheria Mkuu wa Serikali Eliezer Feleshi, Waziri wa Ujenzi Makame Mbarawa, Katibu Mkuu Uchukuzi Gabriel Migire na Katibu wa Bunge Nenelwa Mwihambi. Washtakiwa Waziri wa Ujenzi Makame Mbarawa na Katibu Mkuu Uchukuzi Gabriel Migire walishtakiwa kwa kusaini Mkataba wa kimataifa na kuupeleka bungeni kwa ajili ya kupitishwa bila kushirikisha umma na kutoa nafasi ya kutosha kwa wananchi kutoa maoni yao,
kinyume na sheria ya rasilimali za taifa no.5 ya mwaka 2017 kifungu cha 11 (1) na (2) ambapo sheria inataka mikataba inayohusu Mali asili ya nchi kabla ya lolote kufanyika ni wajibu na lazima kwa Waziri husika kuhakikisha serikali inaweka wazi Mkataba na Makubaliano yote kwa umma kupitia Vyombo vya habari vinavyofikika na wengi kama magazeti, redio za kitaifa, redio za jamii lakini waziri hakufanya hivyo. Mwanasheria Mkuu wa Serikali Eliezer Feleshi na Katibu wa Bunge Nenelwa Mwihambi walishtakiwa kwa kuwaongoza wabunge vibaya kwa kupiga kura za ndiyo badala ya kura ya Mbunge mmoja mmoja kama sheria inavyotaka (Natural Wealth and Resource Contract Act) no.6 ya mwaka 2017 kifungu cha 5 na 6. 

Kesi ilisikilizwa na jopo la majaji watatu ambapo Jaji Dastan Ndunguru ametoa hukumu ya kesi hiyo kuwa hoja zilizotolewa na washtaki zimekosa mashiko na kwa msingi huo mkataba baina ya serikali na kampuni ya DP World hauna dosari za kufanya ushindwe kutekelezwa. Wananchi wamepokea hukumu hiyo kwa masikitiko lakini pia kwa kujua kuwa mahakama zetu hazijawahi kuwa huru. Hukumu iliyotolewa na mahakama ya Kuu Kanda ya Mbeya haijawaha wazi vya kutosha jambo linalodhihirisha wazi kuwa watoa hukumu waliyotoa ni kwa ajili ya kulinda maslashi ya serikali. Ni wakati sasa wa wananchi kuona uhusiano uliopo kati ya haya yanayotokea na katiba mpya kama suluhu kwani wakati umefika wa kudai katiba mpya ili kuondoa mzizi wa maovu yote yanayofanywa na serikali yetu.

In order to defend the country's resources from being plundered and owned by foreigners, Lawyer Boniface Mwabukusi along with other lawyers have represented Tanzanians in a case they opened at the High Court in Mbeya region Tanzania against the port investment agreement between the country's government and Dubai's DP World company. The defendants in the case are Attorney General Eliezer Feleshi, Minister of Construction Makame Mbarawa, Secretary General for Transport Gabriel Migire and Parliament Secretary Nenelwa Mwihambi. The defendants Minister of Construction Makame Mbarawa and Secretary General for Transport Gabriel Migire were accused of signing an international agreement and sending it to parliament for approval without involving the public and giving enough time to citizens to express their views, contrary to the national resources law no.5 of in 2017, section 11 (1) and (2) where the law requires agreements concerning the natural assets of the country before anything is done, it is the duty and obligation of the relevant Minister to ensure that the government discloses all Agreements to the public through the Media accessible to many such as newspapers, national radios, community radios but the minister did not do that. Attorney General Eliezer Feleshi and Parliamentary Secretary Nenelwa Mwihambi were accused of misleading the Members of Parliament by voting a majority vote of yes instead of accepting votes from individual Members of Parliament as required by the law (Natural Wealth and Resource Contract Act) no. 6 of 2017 section 5 and 6.

The case was heard by a panel of three judges where Judge Dastan Ndunguru gave the judgment of the case stating that the arguments made by the accusers are unfounded and on that basis the contract between the government and the DP World company has no flaws to make it impossible to implement. The people have received the verdict with sadness but also knowing that our courts have never been independent. The judgment given by the High Court of Mbeya Region has not been clear enough, which evidently proves that the judgment given aims at protecting the government's interests. It is now time for the people to see the direct relationship that exists between what is happening and obtaining a new constitution as a solution because the time has come to demand a new constitution so as to get rid of the root of all the evils done by our government.
