Mfumo wa haki unapaswa kuwa huru na usio na upendeleo ili kuhakikisha kuwa haki inatendeka kwa watu wote. Mfumo wa haki unapaswa kuheshimu utawala wa sheria na kuwalinda raia dhidi ya ubaguzi na unyanyasaji. Tunatakiwa kuwa sawa mbele ya sheria, aliyenacho na asiye na fedha. Kwa sababu ya mfumo wetu wa sheria kuwa mbovu, kuna watu mahabusu wasiokuwa na uwezo wa kifedha kwenye suala kama la plea bargaining. Serikali ilisema pesa za plea bargaining hazionekani, na mpaka sasa hakuna aliyechukuliwa hatua kutokana na ubadhilifu unaotokana na mfumo mbovu. Hatuwezi kuwa na mfumo wa haki jinai ulio bora bila #KatibaMpya bora.  Plea bargain inatakiwa kuwa na uwazi wa kutosha, mchakato wake unahitaji vyombo vingine huru. Ili kujenga usawa maongezi  na mchakato ya plea bargain lazima yawe wazi kwa umma. Kupora pesa za plea bargaining ni aibu kwa mfumo wa haki na ni wakati wa kuchukua hatua madhubuti. #KatibaMpya inapaswa kuhakikisha kuwa mfumo wa haki unatilia mkazo umuhimu wa haki, usawa na uhuru wa kila mtu.

The justice system should be independent and impartial to ensure that justice is done to all people. The justice system should respect the rule of law and protect citizens from discrimination and abuse. We need to be equal before the law, both the haves (with money) and the have nots (without money). Because of our corrupt legal system, there are inmates who are simply held behind bars because they do not have the financial means to afford a plea bargain. The government recently stated that part of the plea bargaining funds can be traced, but most of it is not available. Until now no one has been held accountable due to corruption resulting from the faulty justice system. We cannot have a better criminal justice system without a new constitution. Plea bargain should be transparent enough, its process needs an independent body apart from the established judiciary. In order to create equality, the negotiations and the plea bargain process must be open to the public. Plundering plea bargaining is a disgrace to the justice system and it is time to take decisive action. A new constitution will ensure that the justice system emphasizes the importance of justice, equality and freedom of everyone.
