Baada ya mkataba wa bandari baina ya Tanzania na DP World kuvuja kwa umma, kumekuwa na maswali mengi miongoni mwa wananchi. Moja ya swali linaloulizwa na wananchi ni kwa nini bandari zilizohusishwa kwenye mkataba huo ni bandari za Tanganyika tuu na sio za Zanzibar. Bandari ni suala la Muungano lakini kwa kuwa mfumo wetu mbovu wa kikatiba tuna sheria ya bandari inayotumika Tanganyika tuu. Katiba inasema moja kati ya mambo ya Muungano ni bandari, ibara ya 200 inasema serikali ya Zanzibar itakuwa na mamlaka ya kusimamia mambo ambayo si ya Muungano pekee.

Sheria ya Bandari ya 2004 inaunga mkono jedwali la kwanza la katiba ya Tanzania kwamba bandari zinapaswa kusimamiwa kwa sheria za Muungano na kusimamiwa na serikali ya jamhuri ya muungano wa Tanzania. Ila waliopewa dhamana ya kuilinda katiba na kusimamia wameshindwa kutimiza wajibu wao wa kuhakikisha katiba haivunjwi na mtu yoyote ikiwemo serikali ya Zanzibar au watendaji wengine wa serikali hizi mbili. Wananchi wamesema kuwa sakata la bandari halijaibua kero mpya za Muungano bali  limedhihirisha namna gani katiba ya muungano inavunjwa na Serikali imeshindwa kulinda Katiba.

Many questions have surfaced among the people after the port contract agreement between Tanzania and DP World was leaked to the public, many questions have surfaced there have been many questions among citizens. One of the questions asked by the people is why the ports involved in the contract agreement are only the ports from Tanganyika and not Zanzibar. Tanzania’s ports are a union matter, but since our constitutional system is corrupt, we have port laws that only apply to Tanganyika. The Constitution states  ports operations to be one of the union matters in Article 200 and that the government of Zanzibar will have the authority to manage matters outside the union. 

The Ports Act of 2004 supports the first table of the Tanzanian constitution that ports should be governed by the laws of the Union and managed by the government of the United Republic of Tanzania but those who are entrusted with protecting the constitution have failed to fulfill their duty at ensuring that the constitution is not violated by anyone including the government of Zanzibar or executives of these two governments. As per the citizens' opinions, the port saga has not raised new problems for the Union but has shown how the union constitution is being violated and the Government has failed to protect the Constitution.
