Katiba Jana na Leo - Jenerali Ulimwengu

Mjadala  umeangalia jinsi katiba yetu ya sasa  imekua ikitumika kwa kipindi chote cha nyuma, Nini kinatarajiwa na wananchi katika #KatibaMpya  kutazamia matarajio tukiwa na  Jenereali Ulimwengu ambaye ni Mwandishi wa habari na Wakili wa Mahakama Kuu .

Kunamambo yamekuwa yakifanyika nchini kana kwamba hatuna katiba. Serikali imekuwa ikifanya mambo kinyume na katiba ya sasa hivyo kuhibua hoja kwamba hata katiba ya sasa tunayojaribu kuiandika upya inaonekana kutoheshimika na viongozi wa serikali,. Marehemu Rais Magufuli aliweka vikwazo kwa vyama vya siasa vya upinzani kufanya shughuli zao za kisiasa kinyume na katiba, . Vyama vya siasa vina haki zao zilizotajwa kwenye katiba lakini polisi wanatumiwa kukandamiza haki hizo kwa kupendelea chama tawala. Polisi wanaonekana kuzuia maandamano halali ya wananchi na pia ya vyama vya upinzani, hii imekua ikikandamiza haki ya wananchi ya kujieleza na kukusanyika ambayo kwa mujibu wa katiba ni moja ya haki za msingi.

Wananchi wanaitaka Serikali kuacha kutumia sheria za kuwanyanyasa watu katika jamii. Katiba itamke kuwa kusiwe na sheria za kurudi nyuma, hizo ni sheria zinazopingana na ile ambayo tayari imetamkwa kwenye katiba mfano wa zuio kwa vyama vya upinzani kufanya mikutano ya vyama vyao. Wananchi pia wameitaka Serikali ijifunze kutokana na makosa ya nchi nyingine wakichukua mfano wa nchi jirani ya Kenya waliopoteza maisha ya watu 1500 katika harakati zake za kupigania katiba mpya. Rais na Serikali yake wanapaswa kufuata na kuheshimu katiba ya sasa. Maslahi ya Rais yawe sawa na ya wananchi. Madaraka hayo yarudi mikononi mwa wananchi ili wawajibishe viongozi na kuendeleza utawala bora.

This Maria Space discussion focuses on looking at how the current constitution has been exercised over the years while looking towards projections for a new constitution with Jenereali Ulimwengu as a special guest speaker. Jeneali Ulimwengu is a journalist, lawyer and the Chairman of the Board of Directors at Raia Mwema Newspaper in Dar-es-Salaam.

The opening started by highlighting the way things have been happening in the country as if we do not have a constitution in place. The government has been doing things contrary to the current constitution hence even the current constitution that we are trying to rewrite seems to be better off if it were practiced than what is currently happening on ground. The late President Magufuli imposed restrictions on opposition political parties but also within the ruling party CCM and tried to uniformize the political thinking in that once something is said or decided by the party head then no one is to think otherwise. Political parties have their rights stated in the constitution but the police are being used to suppress those rights in favor of the ruling party. The police are seen to prevent lawful protests by citizens but also by opposition political parties constraining the people's right to freedom of expression and assembly which by the constitution is one of the fundamental rights. 

The people are calling out to the government to stop weaponizing laws to harass people in society.  The constitution should state that there should be no crawl back laws, that is laws that contradict that which is already stated in the constitution example of the ban of opposition parties from holding their party meetings. Citizens urge the government to learn from the mistakes of other countries taking an example of our neighbor country Kenya who lost the lives of 1500 people in its fight for a new constitution. The President and her government should follow and respect the current constitution. The interests of the President should be the same as that of the people. The power should be returned to the hands of the people so they can hold leaders accountable and promote good governance.
