WANANCHI KUKATAA UONEVU – TUMEFANYA VYA KUTOSHA

Mjadala  umehoji jitihada za wananchi katika kukataa uonevu unaofanyika dhidi yao.  Uonevu kwa wananchi umekuwa ukionekana katika maeneo mbalimbali kwanzia katika haki za mwananchi mmoja mmoja, kwenye ngazi ya vyama ya upinzani na kwa wanaopigania haki.

Mfano mzuri wa hukumu ya kesi dhidi ya wananchi wa Loliondo na Serikali ambapo Mahakama ya Afrika Mashariki (EACJ) imeshindwa kuiwajibisha serikali ya Tanzania kwa kudhulumu haki za binadamu za Wamasai huko Loliondo ambao waliwasilisha kesi hiyo dhidi ya serikali ya Tanzania kwa lengo la kuomba msaada kwa kufukuzwa kwa vurugu na kuchomewa nyumba, kukamatwa kiholela na kutaifishiwa mifugo – Agosti 2017, pamoja na unyanyasaji na kukamatwa kwa wanakijiji wanaohusika na kesi hiyo na polisi. Serikali ilidai kuwafurusha watu hao kulifanyika kwa “heshima” na kwamba vijiji hivyo vimewekwa ndani ya Hifadhi ya Taifa ya Serengeti kinyume cha sheria. Kabla ya uamuzi huo, serikali pia ilisisitiza kuwa EACJ haikuwa na mamlaka ya kusikiliza kesi hiyo kwani ilishaweka sheria inayokataza kuishtaki Serikali.

Uonevu ulionekana katika kauli ya Spika wa bunge iliyoashiria kwamba Rais au kiongozi yeyote wa chama kikuu hapaswi kupingwa wala kuhojiwa na wananchi na yeyote atakayehoji ashughulikiwe imeonyesha wazi jinsi gani wananchi wameporwa mamlaka yao. Wananchi wamepaza sauti kuwa wana haki ya kumkosoa Rais na wana wajibu wa kuikosoa Serikali ili ijiendeshe vizuri kwani nchi ni mali ya wananchi na wananchi ndio msingi wa madaraka yote. Wananchi waliongezea kuwa Spika amepoteza uhalali wa kuwa spika, kwani bunge ni chombo cha kutunga sheria na yeye ameonekana akihamasisha uvujifu wa sheria.

Wananchi pia wamepinga uonevu dhidi ya katazo kwa yama ya siasa vya upinzani kuendesha mikutano yao ya hadhara . Katiba imeruhusu vyama vya siasa kufanya mikutano yake ya hadhara lakini kwa kauli ya Rais jambo ambalo sio sheria linafanyika kuwa sheria na jambo ambalo ni sheria linafanyika kuwa sii sheria. Ni wakati wa vyama kudai mikutano ya hadahara na wananchi kuwaunga mkono.

Wananchi wamekubaliana ya kuwa wapo nyuma katika juhudi za kupinga uonevu na kudai haki zao kisheria na kikatiba. Hivyo wananchi wamehimizana katika kuungana katika kupinga uonevu unaofanywa na chama tawala ambao wanachama wake wamekuwa wakijiona kuwa ndio washika nchi na wamekuwa wakichukulia mambo mikononi. Swala la katiba mpya ni swala la kila mwananchi na si ya chama kimoja tuu. Hivyo juhudi za kupata ni jukumu la wote.

This discussion has questioned the efforts of the people in rejecting the oppression that is done against them. Oppression towards citizens has been seen in various areas, from the rights of individual citizens, at the level of opposition parties and those fighting for justice.

A good example of the judgment of the case against the people of Loliondo and the Government where the East African Court (EACJ) has failed to hold the Tanzanian government responsible for abusing the human rights of the Maasai in Loliondo who filed the case against the Tanzanian government with the aim of asking for help to violent eviction and burning of houses, arbitrary arrests and confiscation of livestock – August 2017, as well as harassment and arrest of villagers involved in the case by the police. The government claimed that evicting the people was done with dignity and that the villages were placed inside the Serengeti National Park illegally. Before the decision, the government also insisted that the EACJ did not have the authority to hear the case as it had established a law that prohibits suing the government.

Citizen oppression was seen in the recent statement by the Speaker which indicated that the President or any leader of the main party should not be challenged or questioned by the people and anyone who questions should be dealt with. It has clearly shown how the people have been robbed of their power. The people have raised their voice that they have the right to criticize the President and they have the responsibility to criticize the Government so that it accomplishes its responsibilities and obligations diligently because the country belongs to the people and the people are the basis of all power. The citizens added that the Speaker has lost the legitimacy of being the speaker, as the parliament is a law-making body and she has been seen to encourage the breaking of the law.

The citizens have agreed that they are behind in efforts to resist oppression and claim their legal and constitutional rights. Thus, the people have encouraged each other to unite in opposing the oppression by the ruling party whose members have been considering themselves to be the custodians of the country and have been taking matters into their own hands. The issue of the new constitution was reminded to be an issue of every citizen and not just one party.
